RENDERED FITS LTD End-User Terms of Use Virtual Try-On Feature — Terms, Consent, and Privacy Version 1.3 Last updated: 30 October 2026 Rendered Fits Ltd Company No. 16922551 50-54 Oswald Road, Scunthorpe, North Lincolnshire, DN15 7PQ mail@renderedfits.com | renderedfits.com This document contains: (A) the End-User Terms of Use; (B) the End-User Privacy Notice; (C) the Standard Consent Flow (UK/EU/ROW); and (D) the Enhanced US Consent Flow (BIPA-compliant). PART A: END-USER TERMS OF USE Virtual Try-On Feature IMPORTANT — PLEASE READ BEFORE USING THE VIRTUAL TRY-ON FEATURE The upload notice reads: "By uploading a photo you agree to our Terms and Privacy Policy." If you do not agree, please do not use the Virtual Try-On feature. 1. What is the Virtual Try-On Feature? 1.1 The Virtual Try-On feature (the “Feature”) is provided by Rendered Fits Ltd (“we”, “us”, or “our”) and is embedded in this online store (operated by the “Merchant”). The Feature allows you to upload a photograph of yourself and receive an AI-generated image showing you wearing a product from this store. 1.2 The Feature is powered by artificial intelligence. The images it produces are AI-generated and are not photographs. They are illustrative only and may not accurately represent how the product will look or fit in real life. 2. How Your Photograph is Processed 2.1 When you upload a photograph: (a) Before upload, the widget checks — entirely within your browser, on your own device — that your photograph contains exactly one face. The number of faces found is discarded straight away. The on-screen position of your face, which is only used to place your photo, is kept with your saved photo in your browser’s storage on your device for up to 30 days unless you clear it (see clause 2.1(f)). Neither is ever sent to us. (b) Your photograph travels from your browser through the store’s Shopify app proxy (operated by Shopify Inc.) to our servers, hosted on Google Cloud Platform in the europe-west2 (London, UK) region, and from there to the AI service, along with an image of the product you selected. (c) The AI combines these to generate a virtual try-on image, which is sent back to your browser. (d) When you use virtual try-on, your photo is used only to create your try-on image. We store your photo and the generated image temporarily. We intend to delete them from our storage after 1 day, and we aim for this to happen within 48 hours. This is a target we are still putting in place, not a guarantee. Links to view or share a generated image expire after 15 to 60 minutes. To create the image, your photo is sent to our AI provider, Google (Gemini Developer API). Google keeps the photo and the generated image for up to 55 days for abuse monitoring. Our system logs are kept for up to 30 days. Our database backups are kept for up to 30 days and hold references to stored files, not the files themselves. A copy of your photo may be kept in your own browser on your device. It is removed 30 days after you last saved it (the next time the page is used after that), or sooner if you withdraw consent. Any image you download is your own copy on your own device. (e) The generated image is included in clause 2.1(d). Links to view or share a generated image expire after 15 to 60 minutes. (f) A copy of your photo may be kept in your own browser on your device. It is removed 30 days after you last saved it, together with the point used to position it on screen (the next time the page is used after that), or sooner if you withdraw consent. (g) Google states that the Gemini Developer API retains prompts, contextual information and outputs for fifty-five (55) days for abuse monitoring. For this service, the request contains your submitted photograph and the response contains the generated output. Google states that paid-service prompts and responses are processed under its Data Processing Addendum for Products Where Google is a Data Processor (https://business.safety.google/processorterms/), and may be transiently stored or cached for safety, policy enforcement and required legal or regulatory disclosures in any country where Google or its agents maintain facilities. See https://ai.google.dev/gemini-api/terms, https://ai.google.dev/gemini-api/docs/usage-policies and https://ai.google.dev/gemini-api/docs/zdr. 2.2 We do not (except where you choose to create a Fit Passport under clause 2.4): (a) store your photograph in any permanent database on our systems (we intend to keep it only temporarily, as described in clause 2.1(d)); (b) use your photograph to recognise or identify you (the one-face check described in clause 2.1(a) runs in your browser and its result is not sent to us); (c) use your photograph for advertising, marketing, profiling, identification or surveillance. Rendered Fits processes it to generate the virtual try-on image you requested; Google’s separate safety, policy-enforcement and legal processing is described in clause 2.1(g); (d) sell, rent, trade, or share your photograph or any data derived from it with any third party (other than Shopify Inc., which transits the upload via the store’s app proxy, and Google’s Gemini Developer API, which generates your try-on image and carries out the separate safety, policy-enforcement and legal processing described in clause 2.1(g)); or (e) use your photograph to train AI models. We do use sizing information you give us (such as measurements and whether you kept or returned an item) to improve our size recommendations, as described in our Privacy Policy. 2.3 Optional size recommendation. You may choose to provide your height, weight, gender presentation, and fit preference (and optionally your age) to receive an AI size recommendation for the selected product. This information is personal data and is sent from your browser via the store’s Shopify app proxy to our servers. Recommendation results are cached for up to 7 days (keyed by product and measurement combination), and an anonymous record of the body specification and predicted size — containing no name, contact details, or customer identifier — is retained to improve fit accuracy. If you are logged in to the store and choose “save my profile”, your measurements are stored against your customer profile for that store only and are deleted when you ask the store to delete your data. 2.4 Optional Fit Passport. You can choose to create a Fit Passport — an optional, free account that saves your measurements and, if you tick a separate box, your photographs, so you can reuse them on any store that uses the Feature. If you create one, Rendered Fits Ltd (not the store) is responsible for that data and stores it as described in the Fit Passport Privacy Notice at renderedfits.com/legal/fit-passport-privacy-notice: each type of data is saved only if you tick its own box; stored photos are kept for repeat try-ons until you delete your passport, withdraw consent or ask us to delete them; everything is held on Google Cloud in London (UK); and when you delete your passport, withdraw consent or ask us, we delete them from our live systems straight away. If you never create a Fit Passport, no persistent passport copy is created; the standard temporary lifecycle in the rest of this clause 2 applies in full. 3. AI-Generated Content Disclaimer 3.1 Virtual try-on images are generated by artificial intelligence. You acknowledge and agree that: (a) virtual try-on images are AI-generated interpretations, not photographs or exact representations; (b) the AI may not perfectly replicate colours, textures, fit, proportions, or other characteristics of the actual product; (c) you should not rely on virtual try-on images as a guarantee of how a product will look or fit; (d) the AI may occasionally produce unexpected, imperfect, or inaccurate results; and (e) virtual try-on images are digitally marked as AI-generated content. (f) the AI may slightly modify the appearance of customers, including adjustments to lighting, hair positioning, or posture 4. Notice Regarding Facial Features and Biometric Data 4.1 In the course of generating your virtual try-on image, our AI technology analyses the facial features and body shape contained in the photograph you upload. We want you to understand the following before you proceed: (a) Purpose. Rendered Fits analyses the facial features in your photograph to generate a virtual try-on image showing you wearing the selected product and does not use the photograph for identification, surveillance, profiling or advertising. Google separately states that it logs paid-service prompts and responses to detect and prevent policy violations, maintain service safety and security, and make required legal or regulatory disclosures. (b) No facial recognition. Before upload, a check runs in your browser to confirm the photo shows one face; its result is not sent to us. We do not use your photo to recognise or identify you. The AI processes your photograph as a whole image to generate the try-on output. (c) No sale or disclosure. Your photograph and any data relating to your facial features will not be sold, leased or traded. It is disclosed to Google’s Gemini Developer API to generate your virtual try-on image; Google’s separate safety, policy-enforcement and legal processing is described in clause 4.1(a). (d) Deletion. When you use virtual try-on, your photo is used only to create your try-on image. Google's separate retention described in clause 2.1(g) still applies. (e) Retention and destruction policy. We maintain a publicly available Biometric Data Retention and Destruction Policy, which sets out our full retention schedule and destruction procedures. This policy is available at: renderedfits.com/legal/biometric-policy 4.2 By uploading a photo you agree to our Terms and Privacy Policy. 4.3 You may stop using the Virtual Try-On Feature at any time. We still intend to delete photographs already on our systems after 1 day; this is a target we are still putting in place, not a guarantee. You may also ask us to delete them by contacting us. 5. Age Restriction 5.1 AI size recommendations, virtual try-on and the Fit Passport are intended for people aged 18 or over. Please do not use them, or upload a photo of anyone, if you or they are under 18. 5.2 A parent or guardian cannot consent on behalf of an under-18 user for these product services. 6. Acceptable Use 6.1 When using the Virtual Try-On Feature, you agree that you will: (a) only upload photographs of yourself; (b) not upload a photograph of any person under 18, including where a parent or guardian has consented; (c) not upload any image that is illegal, offensive, harmful, defamatory, obscene, or that infringes any third party’s rights; (d) not attempt to manipulate, reverse engineer, or abuse the Feature in any way; and (e) not use the Feature for any unlawful or fraudulent purpose. 6.2 We reserve the right to refuse or disable access to the Feature if we reasonably believe these Acceptable Use rules have been violated. 7. Rate Limiting and Session Data 7.1 To prevent abuse, we temporarily record your IP address for the purpose of rate limiting (for example, limiting the number of virtual try-on images that can be generated per hour). This record expires automatically when your session ends. 7.2 The Feature uses a small number of first-party cookies and browser storage items on your device, all functional and all clearable through your browser settings: cookies rf_id (a 24-hour attribution/session identifier, also written as a Shopify cart attribute so the store’s order records reflect try-on involvement) and rf_user_rate_limit (a 24-hour fair-use counter); localStorage items rf_user_photos_v1 (a copy of your photo may be kept in your own browser on your device; it is removed 30 days after you last saved it, together with the point used to position it on screen, the next time the page is used after that, or sooner if you withdraw consent), rf_user_measurements_v2 (your saved measurements), rf_pending_generation_v1 (resume state for an in-progress generation) and rf_nudge_last_shown (a timestamp limiting a one-off prompt); and sessionStorage items rf_looks (your generated looks for the current browsing session) and rf_entry_sub_ok_v1 (a subscription check cache). None of these are used for advertising or tracking. 7.3 If you complete a purchase after using the Feature, an anonymous session identifier may be used to attribute the purchase to the try-on session. This allows the Merchant to measure the effectiveness of the Feature. No personally identifiable information is used for this purpose. 8. Intellectual Property 8.1 You retain ownership of any photograph you upload to the Feature. By uploading a photograph, you grant Rendered Fits a limited, temporary, non-exclusive licence to process it to generate your virtual try-on image. Google’s separate provider processing is described in clause 2.1(g). 8.2 The virtual try-on images generated by the Feature are AI-generated content. The copyright status of AI-generated images may be uncertain under applicable law. The Merchant is granted a licence to use the generated images in connection with the operation of their store. You may save and use the generated images for your personal, non-commercial use. 8.3 All intellectual property rights in the Feature itself (including its software, design, and underlying technology) belong to Rendered Fits Ltd. 9. No Warranties 9.1 The Virtual Try-On Feature is provided “as is” and “as available”. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. 9.2 We do not guarantee that the Feature will be available at all times. The Feature may be temporarily unavailable due to maintenance, technical issues, or the unavailability of our AI service provider. 9.3 Nothing in these Terms affects your statutory rights as a consumer under applicable law. 10. Limitation of Liability 10.1 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by applicable law. 10.2 Subject to the above, to the maximum extent permitted by applicable law, we shall not be liable to you for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising from your use of the Feature, including any losses arising from inaccurate or unexpected AI-generated outputs. 10.3 Our total aggregate liability to you in connection with the Feature shall not exceed one hundred pounds sterling (£100). 11. Governing Law 11.1 These Terms are governed by the laws of England and Wales. If you are a consumer, you may also benefit from any mandatory consumer protection provisions of the laws of the country in which you are resident.
